EFFECTIVE 09/01/2006

RJ Performance issues this non-transferable limited warranty to you, the original purchaser of “the surplus engine / transmission / components”, hereafter known as “the unit”, and the owner of the vehicle in which “the unit” is to be installed.  RJ Performance warrants “the unit”, which you have just purchased and which is described in this warranty, to be free from defects in material or workmanship if properly installed, used in a normal manner and properly serviced and maintained during the specified warranty periods described below.  If “the unit” fails as a result of a defect in material or workmanship during the specified warranty period (measured from the date of receipt) RJ Performance will:

1.    For Surplus and Test Engines / Transmissions:

  1. a. 12 month, Unlimited miles, parts only.
  2. b. Warranty only covers the engine and major components (engine, internal parts, fuel system,
    turbocharger).  This excludes any and all accessories (alternator, power steering pump, a/c
    compressor, etc.) 
  3. c. Repair, replace or refund at the option of RJ Performance, the allegedly defective engine / transmission or part.
  4. d.All labor costs are excluded.

2.   Xceptional 6500 Series Stage 1 Short Blocks:

  1. a. 90 Days (All Vehicles), Unlimited Miles, parts only.
  2. b. Repair, replace or refund at the option of RJ Performance, the allegedly defective engine or part.
  3. c. Warranty only covers the components supplied, with the exclusion of the brand name seals and
    gaskets supplied.
  4. d. Crank Shaft Failures are exempt for warranty policy, unless failure was due to improper installation.
  5. e. All Labor Costs are Excluded

3.    For Cylinder Heads:

  1. a. 12 Month warranty, parts only.
  2. b. Repair, replace or refund at the option of RJ Performance, the allegedly defective part.
  3. c. All labor costs excluded.

4.  For Turbochargers and Injection Pumps:

  1. a. 12 Month warranty, parts only.
  2. b. Repair, replace or refund at the option of RJ Performance, the allegedly defective part.
  3. c. All labor costs Excluded.

5.   New Factory Built Assembly Engines

  1. a. 2 Year / Unlimited Mileage Parts and Labor Warranty Available from Manufacturer.
  2. b. RJ Performance does not underwrite or express any warranty liability.
  3. c.  Be sure to register your factory warranty at time of installation

Disclaimer and Exclusions to Coverage

Warranty period commences the day the product is delivered to the original purchaser.   This warranty, however, does not cover any labor costs incurred in diagnosis of defects, removal or reinstallation of a product, nor does it cover any other consequential expenses.

This limited warranty does not apply if “the unit” is:

  1. Installed in vehicles used for racing or contains high performance modifications
  2. Modified, altered, abused, unreasonably used, improperly installed, damaged by accident, fire, negligence, misuse, overheating, detonation, or lack of lubrication; also included but not limited to: installed in incorrect application, incorrect or defective units or accessory equipment attached to the engine not authorized by RJ Performance, not installed into an application in which it was originally intended.
  3. Not properly serviced, maintained or fuelled in accordance with the original manufacturer’s specifications.
  4. This warranty shall not apply to any standard production engine, which has been adapted to propane or L.P.G. fuels.

This limited warranty excludes:

  1. Transportation expense of a defective engine or part to or from RJ Performance.
  2. Compensation for inconvenience or loss of use.
  3. The cost of a rental car, storage fees, lodging, reimbursement for time off work, loss of income, commercial loss, towing charges, telephone calls, legal fees and costs, oil, filters, anti-freeze fluids or other consequential damages.
  4. Repairs otherwise covered if performed without prior authorization form RJ Performance or specifically authorized for local purchase.
  5. All allegedly defective products must be returned pre-paid for inspection for the warranty to be considered. 

No implied warranty, including any implied warranty of merchantability or fitness for particular purpose, applies to “the unit” after the applicable period of the expressed limited warranty stated above, and no other express warranty or guaranty, except as mentioned above, given by any person or entity with respect to “the unit” shall bind RJ Performance.  RJ Performance shall not be liable for loss of revenues or profits, inconvenience, expense for substitute equipment or service, storage charges, or any other special, incidental or consequential damages caused by the use or misuse of, or inability to use, “the unit”, regardless of the legal theory on which the claim is based, and even if RJ Performance has been advised of the possibility of such damages.  In no event shall recovery of any kind against RJ Performance be greater in amount than the purchase price of the unit sold by RJ Performance.  Without limiting the foregoing, you assume all risk and liability for loss, damage or injury to you and your property and to others and their property arising out of use or misuse of, or inability to use, “the unit” not caused directly by the negligence of RJ Performance.  This limited warranty shall no extend to anyone other than the original purchaser of the unit, or the person for whom it was purchased, and states your exclusive remedy.  All contests to this Limited Warranty must be presented solely in the Court of Queen’s Bench in Calgary, Alberta Canada.

BASIC OVERVIEW OF WARRANTY PROCEDURE

Customer must first phone RJ Performance and notify of the problem.Upon the discrepancy of RJ Performance the defective part will either be repaired locally or sent back to RJ Performance for warranty inspection.

A third party company will be contracted to perform the warranty inspection.  This will eliminate any bias decisions. 

    i If the inspection shows that the warranty issue was that of material defects or poor workmanship the appropriate steps will be taken to have the product fixed and returned as promptly as possible.  Inbound freight will be reimbursed. 
  1. ii If it arrives that the warranty problem is not that of material defects or poor workmanship the customer will be contacted and has the decision to: a) have the 3rd party shop repair the unit, incurring all charges along associated or b) have the product returned freight collect to the location of their choice.

All documentation from the 3rd party inspection company is available and can be produced upon request.
